Terms and Conditions for The Hungry Mind Catering

Please read these Terms and Conditions ("Agreement") carefully before placing an order with The Hungry Mind Catering. This Agreement sets forth the terms and conditions governing the use of our catering services. By placing an order, you accept and agree to be bound by this Agreement.

1. Ordering:

1.1 Order Cut-Off Time:
All catering orders must be placed and confirmed by 2:00 PM, two (2) days prior to the scheduled delivery or event date. Orders received after the cut-off time may not be accepted, subject to availability.

1.2 Order Confirmation:
Once your order is received, we will review it and send you an order confirmation. The order confirmation will include the details of your order, including the menu items, quantities, delivery/pickup information, and total cost.

2. Payment Terms:

2.1 Payment in Full:
All orders must be paid in full prior to delivery or pickup, unless you have an approved credit account with The Hungry Mind Catering.

2.2 Credit Accounts:
Customers with approved credit accounts will be invoiced for their orders and must make payment within seven (7) days from the date of the invoice.

2.3 Payment Methods:
We accept payment by credit/debit card or electronic funds transfer. Payment details and instructions will be provided in the order confirmation.

2.4 Late Payment:
Failure to make payment within the specified timeframes may result in the cancellation of your order or suspension of your credit account, as applicable. Any outstanding balances will accrue interest at a rate of [insert interest rate] per month or the maximum rate allowed by law, whichever is lower.

3. Cancellation and Modification:

3.1 Cancellation by Customer:
Cancellations made more than 48 hours before the scheduled delivery or event date may be eligible for a refund, subject to a cancellation fee of [insert cancellation fee]. Cancellations made within 48 hours of the scheduled delivery or event date may not be eligible for a refund.

3.2 Cancellation by The Hungry Mind Catering:
In the event that The Hungry Mind Catering is unable to fulfill your order due to unforeseen circumstances, we reserve the right to cancel the order and provide a full refund. We will make every effort to notify you as soon as possible in such cases.

3.3 Order Modifications:
Modifications to your order, including changes to menu items, quantities, or delivery/pickup details, may be accommodated subject to availability and at our discretion. Please contact us as soon as possible to request any modifications.

4. Food Safety and Allergies:

4.1 Food Safety:
The Hungry Mind Catering adheres to strict food safety and hygiene practices to ensure the quality and safety of our food. However, we cannot be held liable for any food-related allergies or illnesses that may arise from consuming our products if proper storage, handling, or dietary restrictions have not been communicated to us in advance.

4.2 Allergies and Dietary Restrictions:
Please inform us of any specific allergies or dietary restrictions when placing your order. While we make every effort to accommodate special requests, we cannot guarantee the complete absence of allergens or cross-contamination.

5. Liability:

5.1 Limitation of Liability:
To the extent permitted by law, The Hungry Mind Catering shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with our catering services, including but not limited to, food quality, late deliveries, or any other issues that may arise.

5.2 Indemnification:
You agree to indemnify, defend, and hold harmless The Hungry Mind Catering and its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising out of or in connection with your use of our catering services or any violation of this Agreement.

6. Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

7. Severability:

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

8. Entire Agreement:

This Agreement constitutes the entire agreement between you and The Hungry Mind Catering and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

By placing an order with The Hungry Mind Catering, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
